{"id":2741,"date":"2021-11-15T13:56:55","date_gmt":"2021-11-15T21:56:55","guid":{"rendered":"https:\/\/usezloan.com\/?p=2741"},"modified":"2021-11-15T13:57:07","modified_gmt":"2021-11-15T21:57:07","slug":"2741","status":"publish","type":"post","link":"https:\/\/usezloan.com\/index.php\/2021\/11\/15\/2741\/","title":{"rendered":"\uc735\uc790\uc9c0\uc2dd 244-APR Accuracy and Redisclosure"},"content":{"rendered":"<h2><\/h2>\n<h2><\/h2>\n<h2><\/h2>\n<h2>\uc735\uc790\uc9c0\uc2dd 244-APR Accuracy and Redisclosure<\/h2>\n<p>APR Accuracy and Redisclosure<br \/>\nAccording to Regulation Z, the annual percentage rate is generally considered accurate if it does not<br \/>\n27 | P a g e<br \/>\nvary above or below the APR initially disclosed by more than:<br \/>\n\u2022 1\/8% (.125) for a regular transaction (30-year fixed\/Traditional Mortgage)<br \/>\n\u2022 1\/4% (.25) for an irregular transaction (Not a 30-year fixed\/Non-traditional mortgage)<br \/>\nAn irregular transaction is defined as one that includes one or more of the following features:<br \/>\n\u2022 Multiple advances<br \/>\n\u2022 Irregular payment periods<br \/>\n\u2022 Irregular payment amounts (other than an irregular first period or irregular first and final<br \/>\npayment)<br \/>\nIf a change renders the APR inaccurate prior to loan consummation, TILA requires that the borrower<br \/>\nbe given a corrected disclosure of all terms.<br \/>\n\u2022 The consumer must receive the corrected Closing Disclosure no later than three (3) days prior<br \/>\nto loan consummation or the corrected Loan Estimate no later than four (4) business days<br \/>\nprior to loan consummation.<br \/>\n\u2022 If the corrected disclosures are mailed or delivered by some method other than in person, the<br \/>\nconsumer is considered to have received them three (3) business days after they were mailed.<br \/>\nA borrower may be able to waive the waiting periods if there is a bona fide personal financial<br \/>\nemergency (lender determines if it\u2019s a valid emergency). Also, remember that consumers are not<br \/>\nrequired to continue with the loan during these waiting periods simply because the creditor provided<br \/>\nthese disclosures.<br \/>\n2.23 The Mortgage Disclosure Improvement Act (MDIA)<br \/>\nThe Mortgage Disclosure Improvement Act (MDIA) states that:<br \/>\n\u25aa Initial disclosures are required within three (3) business days of receipt of completed<br \/>\napplication.<br \/>\n\u25aa Earliest consummation is on the 7th business day after disclosures delivered\/mailed.<br \/>\n\u25aa If redisclosure is required &#8211; consumer must receive corrected disclosure at least 3 business<br \/>\ndays before loan can be consummated.<br \/>\nExample 1: The creditor takes an application for a fixed rate loan on Tuesday, June 1 and mails the<br \/>\nLoan Estimate the next day, Wednesday, June 2.
