In<br \/>\nthe event that the mortgage loan originator is an employee or exclusive agent of a person subject to<br \/>\nthe SAFE Act, the surety bond of such person, subject to this Act, can be used in lieu of the mortgage<br \/>\nloan originator\u2019s surety bond requirement.<br \/>\nThe surety bond must provide coverage for each mortgage loan originator in an amount and form as prescribed by the State Regulatory Authority. The State Regulatory Authority may promulgate rules or regulations with respect to the requirements for such surety bonds as are necessary to accomplish the purposes of the SAFE Act.<br \/>\nThe penal sum of the surety bond must be maintained in an amount that reflects the dollar amount of<br \/>\nloans originated as determined by the State Regulatory Authority.<br \/>\nWhen an action is commenced on a licensee\u2019s bond, the State Regulatory Authority may require the<br \/>\nfiling of a new bond. Immediately upon recovery upon any action on the bond, the licensee must file a<br \/>\nnew bond.<br \/>\nMinimum Net Worth &#8211; A minimum net worth must be continuously maintained for mortgage loan<br \/>\noriginators. In the event that the mortgage loan originator is an employee or exclusive agent of a<br \/>\nperson subject to the SAFE Act, the net worth of such person subject to this Act can be used in lieu of the mortgage loan originator\u2019s minimum net worth requirement.<br \/>\nMinimum net worth must be continuously maintained in an amount that reflects the dollar amount of loans originated as determined by the State Regulatory Authority. The State Regulatory Authority may<br \/>\npromulgate rules or regulations with respect to the requirements for minimum net worth as are necessary to accomplish the purposes of this Act.<br \/>\nState Fund &#8211; Each state choosing this option must draft unique language establishing a state recovery fund.
