{"id":2535,"date":"2021-10-01T15:15:38","date_gmt":"2021-10-01T22:15:38","guid":{"rendered":"https:\/\/usezloan.com\/?p=2535"},"modified":"2021-10-04T14:57:17","modified_gmt":"2021-10-04T21:57:17","slug":"background-check-and-license-issuance","status":"publish","type":"post","link":"https:\/\/usezloan.com\/index.php\/2021\/10\/01\/background-check-and-license-issuance\/","title":{"rendered":"233-Background Check and License Issuance"},"content":{"rendered":"<p>Background Check and License Issuance<br \/>\nIn connection with an application for licensing as a mortgage loan originator, the applicant shall, at a<br \/>\nminimum, furnish to the NMLS information concerning the applicant\u2019s identity, including:<br \/>\n\u2022 Fingerprints for submission to the Federal Bureau of Investigation (FBI), and any governmental<br \/>\nagency or entity authorized to receive such information for a state, national and international<br \/>\ncriminal history background check.<br \/>\no Fingerprints must be less than 90 days old.<br \/>\n\u2022 Personal history and experience in a form prescribed by the NMLS including:<br \/>\n\u2022 Authorization for the NMLS and the state regulatory authority to obtain an independent credit<br \/>\nreport obtained from a consumer reporting agency described in Section 603(p) of the Fair Credit<br \/>\nReporting Act (FCRA).<br \/>\n\u2022 Credit report authorization less than 90 days old.<br \/>\n\u2022 Records related to any administrative, civil or criminal findings by any governmental jurisdiction.<br \/>\n\u2022 Any other information deemed necessary by the NMLS or state regulatory authority.<br \/>\nIssuance of License &#8211; The minimum standards for licensing and registration as a state-licensed<br \/>\nmortgage loan originator shall include the following:<br \/>\nFinancial Stability &#8211; License applicants must submit their identity, including fingerprints, to the NMLSR. As part of this submission, applicants must consent to a series of criminal background and credit<br \/>\nchecks. The purpose of these checks is to verify that an applicant exhibits fiscal responsibility,<br \/>\ncharacter and general fitness to serve the public as a loan originator. An applicant who lacks these<br \/>\ntraits will not be issued a license.<br \/>\nIf a loan originator\u2019s errors or misconduct result in negative financial consequences for consumers,<br \/>\nthere must be a safeguard in place to help facilitate the payment of compensation. States can work<br \/>\ntoward this requirement by choosing any of the following options:<br \/>\n\u2022 Require that loan originators maintain a net worth that is based on the dollar amount of their<br \/>\noriginated loans. (If this option is chosen, the loan originator might be able to substitute an<br \/>\nemployer\u2019s net worth.)<br \/>\n\u2022 Require that loan originators maintain a surety bond, the value of which is based on the dollar<br \/>\namount of their originated loans. (If this option is chosen, originators must file a new bond if<br \/>\nmoney is ever recovered from one.
