{"id":2518,"date":"2021-09-30T15:33:56","date_gmt":"2021-09-30T22:33:56","guid":{"rendered":"https:\/\/usezloan.com\/?p=2518"},"modified":"2021-10-04T14:54:43","modified_gmt":"2021-10-04T21:54:43","slug":"state-regulatory-authority-responsibilities","status":"publish","type":"post","link":"https:\/\/usezloan.com\/index.php\/2021\/09\/30\/state-regulatory-authority-responsibilities\/","title":{"rendered":"\uc735\uc790\uc9c0\uc2dd227-State Regulatory Authority Responsibilities"},"content":{"rendered":"<p>State Regulatory Authority Responsibilities<\/p>\n<p>At a minimum, each State Regulatory Authority must meet the following requirements:<br \/>\n\u2022 Must provide effective supervision and enforcement of the law, including the suspension, termination or nonrenewal of a license for a violation of any state or federal law.<br \/>\n\u2022 Must ensure that all state-licensed mortgage loan originators operating in the state are registered with the Nationwide Mortgage Licensing System and Registry (NMLS).<br \/>\n\u2022 Must regularly report violations, as well as enforcement actions, and other relevant information, to the NMLS.<br \/>\n\u2022 Must have a process in place for challenging information contained in the NMLS.<br \/>\n\u2022 Must have an established mechanism to assess civil money penalties for individuals acting as mortgage loan originators in their state without a valid license or registration.<br \/>\n\u2022 Must have one of these protection options in place: an established minimum net worth or surety bonding requirement that reflects the dollar amount of loans originated by a residential mortgage loan originator, or have an established recovery fund paid into by mortgage loan originators.<\/p>\n<p>Responsibilities and Limitations: The State Regulatory Authority possess the following responsibilities:<br \/>\n\u2022 Enforcing state licensing laws.<br \/>\n\u2022 Regularly reporting licensing violations to the NMLS-R.<br \/>\n\u2022 Assessing civil penalties against individuals who originate without a license.<\/p>\n<p>Broad Administrative Authority: The State Regulatory Authority must have a broad administrative authority to administer, interpret and enforce the SAFE Act, and to make the rules or regulations<br \/>\nimplementing the Act known, in order to carry out the intentions of the legislature [see12 CFR Part 1008, Subpart B, \u00a71008. 111(b)].<\/p>\n<p>State Examination Authority: In addition to any authority allowed under State law, a state-licensing agency must have the authority to conduct investigations and examinations [see 12 CFR Part 1008,<br \/>\nSubpart B, \u00a71008.111(a)(4)].<\/p>\n<p>Authority to Access Information: For the purposes of initial licensing and license maintenance, the state shall have access to all MLO or mortgage entity records.<\/p>\n<p>Fees: CSBS, AARMR or the Bureau, as applicable, may charge reasonable fees to cover the costs of maintaining and providing access to information from the NMLS-R. Fees shall not be charged to consumers for access to such system and registry. If the Bureau determines to charge fees, the fees to be charged shall be issued by notice with the opportunity for comment prior to any fees being<br \/>\ncharged.<\/p>\n<p>Penalties: The maximum amount of penalty for each act or omission shall be $28,474 as of January 12, 2018 (previously $25,000). Each violation or failure to comply with any directive or order of the<br \/>\nState Regulatory Authority is a separate and distinct violation or failure.<\/p>\n<p>Regulatory Authority Limitations: State and federal regulating authorities do not have the authority, nor are they empowered, to impose a prison sentence.<\/p>\n<p>\uc8fc \uaddc\uc81c \ub2f9\uad6d\uc758 \ucc45\uc784<\/p>\n<p>\uac01
